1. Definitions

  • Booking: Your request to participate in a tour offered by The Uhuru Experience Limited.

 

  • Owner: Naomi Alice Fowler – Founder and CEO of The Uhuru Experience Limited.

 

  • Services: All services offered by the Tour Operator, The Uhuru Experience Limited, include but are not limited to creating and booking tours, providing travel information, and offering customer support.

  • Suppliers: Our third-party providers are responsible for providing the specific tour you have booked. 

 

  • User: You, the individual accessing or using the Website or Services.

 

  • Website: The website is located at uhuruexperience.com.

 

2. Booking and Payment

  • A 30% deposit is non-refundable should the customer decide to cancel their trip.

 

  • The remainder 70% is fully refundable up to 20 days before the trip start date.

 

  • By demand, customers cannot book without travel insurance covering health and property loss of items or flight delays.

 

  • All bookings must be made through the Website.

 

  • You must be at least 18 years old to book a tour.

 

  • You are responsible for ensuring the accuracy of all information provided during the booking process.

 

  • All prices are displayed in Pounds and are subject to change without notice.

 

  • Payment for tours must be made in full at the time of booking via our website. We accept all payment methods.

  • Split payments can be organised via email.

  • We do not store your credit card details.

3. Cancellations and Refunds

  • You may cancel your booking up to 20 days before the tour start date for a full refund, minus a 10% processing fee.

 

  • Cancellations made within 20 days of the tour start date will be subject to a 100% non-refundable, depending on the tour operator’s cancellation policy.

 

  • We reserve the right to cancel or amend any tour at any time due to unforeseen circumstances such as hazardous weather or political changes.
    In such cases, customers will be offered either a partial or full refund. Reschedule options are also available should the customer wish to receive alternative travel arrangments.

 

4. Changes to Tours

  • We reserve the right to make changes to the itinerary or schedule of any tour at any time. We will make reasonable efforts to notify you of any changes in advance.

 

  • If a change significantly alters the nature of the tour, you may cancel your booking for a full refund.

 

5. User Conduct

  • You agree to use the Website and Services lawfully and responsibly.

 

  • You agree not to use the Website or Services for any purpose that is illegal, harmful, or offensive.

 

  • You agree not to interfere with the use of the Website or Services by others.

 

  • You agree not to violate any of these Terms.

 

6. Intellectual Property

  • The Website and Services are protected by copyright, trademark, and other intellectual property laws.

 

  • You may not use any of the content on the Website or Services without our express written permission.

 

7. Disclaimer of Warranties 

  • The Website and Services are provided “as is” and without warranty of any kind.

 

  • We disclaim all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

 

8. Limitation of Liability

  • We will not be liable for any damages arising out of your use of the Website or Services, including but not limited to direct, indirect, incidental, consequential, and punitive damages.

 

  • You agree to indemnify and hold us harmless from any and all claims, losses, damages, and expenses (including attorneys’ fees) arising out of your use of the Website or Services. The Uhuru Experience Limited will not be liable by reason of any delay or cancellations of journeys caused by events that are outside the company’s control which include but are not limited to: Acts of God, government actions, war or national emergencies, acts of terrorism or other related events. Your safety is in our best interest therefore we reserve the right to cancel a tour at any notice or amend a booking. In the case of company liability, the customer will receive either a partial or full refund.

 

  • We will not be held liable for any health-related matters or property damage at the customer’s expense.  

  • Customers agree to have purchased travel insurance before arrival and remain responsible for any travel arrangements prior to arrival.

 

9. Medical Conditions, Disabilities, Reduced Mobility and Special Requests

  • Customers who may have special needs or reduced mobility are welcomed throughout our company however, it is essential you contact us before booking to require information on the suitability of your intended travel plans, so we can correspond with our providers in the destination you wish to travel.

  • Due to the nature of some of our experiences, customers may have to forfeit activities on some of our crafted tours. If you wish to contact us we can possibly make alternative arraignments or tailor a tour to suit your condition however we cannot promise exact deliverability.


  • Adequate health and travel insurance is mandatory for customers with adverse health or mobility conditions.


  • If customers fail to inform us prior to booking of their health and mobility status, we reserve the right to cancel a booking immediately at any given time if we feel the travel arrangements are not suitable. In this case we will not be held liable for any financial loss of travel arrangements in advance to the tour date commencing. 


  • The customer agrees to make the Tour Operator fully aware of any health concerns, allergies and intolerances which may or could effect their travel experience. The customer also takes full responsibility for making their service providers on arrival to each location aware of any health concerns, allergies and intolerances to Tour Guides, Lodges and Accommodation Staff, Restaurants, Cafes, Waiters and Cooks on their tour. You also agree to state the severity of your condition prior to arrival to us, the Tour Operator and to our suppliers on arrival, should the circumstance arise that our service providers cannot promise to accommodate.


  • Special requests on the information of food intolerances, allergies and meal requests for any reason will be passed on to our suppliers however you agree these are requests and cannot be guaranteed. Adequate information on request of deliverability can be provided to our customer before booking but you agree the information given is provided on account of our supplier who remains responsible for your service at your chosen destination.


10. Governing Law and Jurisdiction

  • These Terms shall be governed by and construed in accordance with the laws of England and Wales. You agree that any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the courts of England and Wales.

 

11. Entire Agreement

These Terms constitute the entire agreement between you and us concerning your use of the Website and Services.
